Pennsylvania Personal Injury Laws

The different types of liability for injuries in Pennsylvania include:

  • Negligence – Individuals and businesses generally owe a duty of care. For instance, drivers have a duty to obey the rules of the road and safely operate their vehicles, while a business owner has a duty to keep the premises free of hazards that can harm customers and visitors. If a person or property owner breaches their duty by being negligent or reckless and such behavior results in an accident and another individual’s injury, the injured person can file a personal injury lawsuit against the negligent party to recover compensation for their losses.

  • Medical malpractice – When it comes to injuries and illnesses caused or exacerbated by healthcare providers, you may file a medical malpractice lawsuit. The injured party needs to prove the doctor or medical professional deviated from the standard of care associated with the medical treatment the person received and the healthcare provider’s breach caused the injury/illness.
