Personal Injury Laws in Pennsylvania

  • Medical malpractice – To hold a healthcare provider liable for medical malpractice in Pennsylvania, the injured party must prove the standard of care in the medical community for which the defendant’s treatment should be measured, the defendant deviated from that standard, the defendant’s breach of the required standard of care proximately caused or contributed to causing the plaintiff’s injury, the plaintiff suffered damages as a direct result of the injury.

  • Strict liability – Strict liability allows a plaintiff to sue a person or entity without proving fault or negligence. If a person suffered an injury caused by a dangerous or defective product, he/she can file a products liability claim against the manufacturer to recover damages. Strict liability also applies to injuries from dog bites, commonly known as Pennsylvania’s “one bite” rule.

When it comes to negligence, it is possible that the at-fault party may partially blame the injured party for the incident that led to their injuries. In such cases, Pennsylvania adheres to a “modified comparative negligence” law,” which means that the amount of damages an injured party is entitled to can be reduced by their share of negligence.

For example, if a jury awards you with $100,000 at a civil trial, but also decides you are 25 percent at fault for the accident, your compensation will be reduced by $25,000, so you get to only keep $75,000 of the total award. But if you are found to be more than 50 percent responsible for the accident, you cannot collect anything from the other at-fault parties.

For more personal injury claims, Pennsylvania’s statute of limitations gives an injured party two years to file a lawsuit in civil court.
